Healthcare AI Governance: Moving from Theory to the Bedside
Healthcare AI adoption is currently a performance of speed over safety. This post outlines three critical steps for robust governance.
Our current healthcare AI regulatory standards describe a world of safety, but the 2026 clinical reality tends to be a practical policy vacuum, with studies showing that 78% of hospitals deploy AI without formal oversight, effectively eroding your clinical sovereignty to feed a machine that struggles to be monitored. To compound these challenges; one huge missing piece of the puzzle, the patient. I know, like you, I sit in these discussions and hear patients being added as an afterthought or brushed aside as being irrelevant given the rapid pace of technical innovation.
What shocks me is that I spent over 25 years in marketing communications, where the "customer voice" was a vital part of nearly every discussion. Whether if this was a large pharmaceutical company or a leading university the "customer" the ultimate end user was the focus.
Today, it appears to me we live in the following governance landscapes.
A The Proliferation of Theory. The recognition of a governance crisis has led to a surge in theoretical models. A December 2024 systematic review identified 22 distinct AI governance frameworks attempting to address everything from organizational structure to external product evaluation. While this proliferation suggests a strong intention, a deeper study of these frameworks reveals these may be more aspirational than practical.
A World Focused on Principles Without Protocols. The Hussein et al. (2024) review exposed the primary failure of current oversight: while most frameworks successfully articulate ethical principles, fewer than 30% provide the operational guidance required to translate those values into clinical practice. For the sovereign clinician, this becomes "Ethics Washing" at scale. It creates an environment where institutions can claim to be "principled" while leaving clinicians with no structured authority to challenge unvetted administrative logic or unmonitored drift.
Institutional survey data confirms that healthcare AI adoption is currently a performance of speed over safety. Most alarmingly, fewer than 25% of hospitals possess the technical capacity to produce an audit trail for an AI-influenced clinical decision within 30 days of a request.
The Policy Vacuum: This technical surge is occurring in a total governance vacuum. A December 2025 CHIME Foundation survey revealed that 78% of healthcare IT leaders reported that their organizations lack a formal policy for AI oversight. By failing to establish AI-specific committees, with fewer than 10% currently including patient representatives as voting members, these institutions are operating under massive "Model Risk". This is the danger of basing life-and-death clinical decisions on unmonitored, potentially flawed algorithms that often lack systematic evidence of equitable performance across demographic groups. For the Sovereign Clinician, these metrics are an ultimatum: the institution is prioritizing deployment velocity over your professional authority and your patient's safety.
Where governance structures exist, they tend to replicate existing organizational hierarchies. IT governance committees add AI oversight to their agendas. Clinical informatics teams review algorithms alongside other technical implementations. Quality committees examine AI as one of many quality concerns. What these approaches share is the absence of structures specifically designed to address the unique governance challenges that AI presents.
Notably absent from most governance structures: patients. The ASTP analysis did not even include patient participation as a metric for governance maturity. The CHIME survey found that fewer than 10% of healthcare organizations with AI governance committees included patient representatives as voting members (Censinet, 2025). The committees governing algorithms that affect patients overwhelmingly exclude patients from governance deliberation.
This exclusion reflects the extraction paradigm at the level of governance. Patients are data sources whose information trains and validates algorithms. They are not knowledge partners whose perspectives shape how those algorithms are deployed, monitored, and modified.
The Path Forward - Three Key Steps
1. Build a "Sovereign Clinician Charter" with Frictionless Overrides.

Mirroring the "customer voice" found in pharmaceutical and university marketing, hospitals must treat patients as knowledge partners rather than mere data sources.
- Mandatory Voting Representation: Transition from tokenism to authority by requiring that at least two patient representatives serve as voting members on AI governance committees.
- Operationalize Patient Reality: Deploy a "Patient-Valued Outcomes Rubric" for use-case selection. This ensures algorithms optimize for quality of life and functional capacity rather than just institutional metrics like cost or length of stay.
- Establish Challenge Mechanisms: Create accessible pathways for patients to challenge "Model Risk" when an algorithm's assessment (such as a "non-adherent" label) misses relevant lived context like transportation barriers or medication costs.
3. Establish a "Continuous Validation Command Center

- Move Beyond AUROC (Area Under the Receiver Operating Characteristic curve): Demand validation that addresses Calibration (do predicted probabilities match reality?) and Subgroup Performance (does it work for this specific demographic?).
- Automated Governance Aggregation: Deploy defensive NLP technologies to instantly synthesize clinician override narratives at scale, identifying systemic algorithmic drift before it results in a "Validation Crisis".
- Mandatory "Stop Rules": For every high-risk AI (such as sepsis or deterioration alerts), establish explicit Stop Rules specifying conditions under which the algorithm must be decommissioned or the recommendation rejected, regardless of its statistical confidence.
